The site https://grangettes.store (the "Site") is an e-commerce website open to any user of the Internet network (the "User"). 

The Site is managed by the company Grangettes Switzerland Sàrl ("Grangettes"), having its registered office at Chemin des Verjus 119, 1228 Plan-les-Ouates, Switzerland and registered in the Commercial Register of the Canton of Geneva under number IDE CHE-114.156.519, VAT number CHE114156519 VAT.

Grangettes and the User will each be referred to as [idem], a "Part" and together the "Parties". 

Site Terms of Use

It cannot be used, in particular for commercial purposes, of all or part of the content of the Site which remains the exclusive property of Grangettes even once downloaded. For the rest, art. 13 of the General Conditions of Sale is applicable.

The Site may contain links to other websites managed by third parties. Grangettes declines all responsibility for (i) the content of these sites to which the Site refers and (ii) the damage they could cause to the User.

The User guarantees that he will not use the Site or the services offered for illicit purposes and undertakes to comply with the applicable legislation in the matter.

Only the French version of the Site is legally authentic.

Object - Acceptance of the General Conditions of Sale

Any order placed through the Site assumes the prior acceptance by the User of these General Terms and Conditions of Sale before validation of payment. The General Conditions of Sale must also be accepted when creating a customer account.

The User guarantees that he has read and understood the General Conditions of Sale.

The Parties thus agree that their contractual relations will be governed exclusively by these General Conditions of Sale, subject to the mandatory provisions of the Code of Obligations which would be applicable.

The General Conditions of Sale can be saved and/or printed by the User. Any modification of the latter by the User is however excluded.

The General Conditions of Sale are applicable from November 1, 2021. They can be modified, at any time, by Grangettes without the latter having to inform the User in any way. The version of the General Conditions of Sale applicable to the User for an order are those that he has validated by checking the box "I accept the general conditions" when placing the order.

Offer

Prior to placing any order, the User may browse the Site in order to learn about the essential characteristics of the product(s) he wishes to purchase.

All offers (including promotional offers) are valid as long as they are displayed on the Site. Once they have disappeared, the User can no longer rely on them.

The photographs and other illustrations of the product(s) on the Site are non-contractual. Thus, Grangettes excludes any guarantee and/or liability as to the conformity of the product(s) ordered with the said photographs and/or illustrations.

Price

The prices of the product(s) mentioned on the Site include the total price to be paid for the goods and services concerned in Swiss Francs, all taxes included, excluding delivery charges.

The price of delivery charges is determined at the time the order is placed, depending in particular on the amount of the order. Delivery charges are inclusive of all taxes.

Grangettes Switzerland cannot be held responsible for late deliveries.

Grangettes is free to modify all prices appearing on the Site at any time.

Order

After placing the product(s) in the basket, the User must validate his order by accepting the General Conditions of Sale and proceeding to the payment thereof.". By checking the box "I accept the general conditions" then by clicking on "Payment", the User concludes the sales contract and unconditionally and irrevocably accepts the application of the General Conditions of Sale.

The User accepts that Grangettes' order registration systems constitute proof of the said order, its content and its date.

The sales contract relating to a specific order is considered concluded by Grangettes once the latter has sent the User, by e-mail, the order confirmation containing all the constituent elements of the contract (product/s ordered, amount invoiced, delivery costs, delivery terms, shipping costs, etc.).

In the event that Grangettes is unable to execute the order in whole or in part for any reason whatsoever, it will inform the User as soon as possible by e-mail and will determine with the latter how to proceed.

Grangettes reserves the right to refuse any order, in particular because the latter is abusive, the means of payment is illicit, fraud is suspected or if the User has committed abuses on the Site or in connection with the products. .

Payment

Orders are payable in Swiss francs at the time of payment. The full amount indicated at the time of payment (i.e. price of products and delivery charges) on the Site is due in full at the time the order is placed.

The User may use any of the payment methods offered on the Site. The User guarantees that he/she has the necessary authorization to use the chosen method of payment.

In the event of refusal of payment for the product(s) ordered after Grangettes has sent the order confirmation, Grangettes reserves the right to cancel delivery until the price of the order has been credited to the User's account.

Subject to Grangettes' refusal, Users who are business customers have the option of paying by invoice. In this case, the invoice amount must be paid within 30 days of receipt.

Delivery

The product(s) is/are delivered to the address indicated by the User on the order form, according to the delivery method chosen from among the options available on the Site during the ordering process.

Grangettes is deemed to have fulfilled its delivery obligation upon delivery of the ordered product(s) to the carrier. THE TRANSFER OF RISKS THEREFORE TAKES PLACE AT THE TIME OF DELIVERY OF THE PRODUCT(S) TO THE CARRIER. Grangettes cannot therefore be held responsible for the loss or theft of the product(s) following delivery of the latter(s) to the carrier. Grangettes can in no way guarantee delivery times. However, these will not exceed 30 days following the order confirmation.

Verification of the goods - Return of products

Upon receipt of the product(s), the User is required to check the condition of the package, respectively of the product(s) and to notify the carrier of any damage found or, where applicable, refuse delivery. . The User is advised to take a photo of the package in case of damage. The reservations communicated to the carrier upon delivery as well as the photos taken must be sent to Grangettes at the email address mentioned in art. 1 of the General Terms and Conditions of Sale within ten days of delivery.

In order to avoid any inconvenience, the product(s) are/are systematically checked by Grangettes before shipment. However, if the User is not entirely satisfied with the product(s) purchased on the Site or that the latter(s) is/are defective, he/she may return it/them, even if he/she is/are open, under the following conditions:

  • Sending a refund request using the return form available on the Site within 20 calendar days of receipt of the purchased product(s) subject to return;

  • Sending of the product(s) mentioned in the form to Grangettes at the address mentioned in art. 1 of the General Terms and Conditions of Sale within 20 calendar days of receipt of the product(s), object of the return. The costs relating to this shipment are exclusively borne by the User (whether the initial delivery was free or not).

Any risk related to the return of the product(s) is/are the responsibility of the User

Upon receipt of the product(s) by Grangettes, the latter will refund the amount initially paid by the User for the product(s) to the latter within 14 calendar days to the account mentioned in the return form. In the event that the product(s) is/are defective or damaged, Grangettes will email the User a prepaid return label in PDF format.

Grangettes reserves the right, in the event of abuse by a User, of the right to return the product(s), to refuse to reimburse said product/s.

Right to retract

The User has a period of 20 calendar days from the date of receipt of his order, to return, at his expense, one or more ordered product(s), for reimbursement. The refund will be made by bank transfer to the account whose details will be communicated by the User after exercising the right of withdrawal within 14 calendar days of the date of receipt of the product(s) subject to the right of withdrawal or proof of return of the latter/s.

Any risk related to the return of the product(s) is the responsibility of the User.

Responsibility

GRANGETTES DISCLAIMS ANY RESPONSIBILITY FOR (I) ANY INTERRUPTION OF THE SITE, (II) ANY OCCURRING OF BUGS, (III) ANY DAMAGE RESULTING FROM FRAUDULENT INTRUSION BY A THIRD PARTY LEADING TO A MODIFICATION OF THE INFORMATION MADE AVAILABLE ON THE SITE, (IV) AND MORE GENERALLY FOR ANY DIRECT OR INDIRECT DAMAGE, WHATEVER THE CAUSES, ORIGINS, NATURE OR CONSEQUENCES, INCLUDING LOSS OF PROFITS, CLIENTELE, DATA OR ANY OTHER LOSS OF INTANGIBLE PROPERTY, LOSS OF PROFITS .


UNDER NO CIRCUMSTANCES SHALL GRANGETTES BE HELD RESPONSIBLE FOR INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY NATURE WHATSOEVER (EVEN IF THE BIRTH OF SUCH DAMAGE WAS KNOWN OR COULD HAVE BEEN KNOWN BY GRANGETTES) ARISING IN CONNECTION WITH ITS PRODUCTS , THEIR USE, SALE OR THE SITE.


THE USER CANNOT, IN ANY CASE AND WHATEVER THE SUBJECT OF HIS REQUEST (DEFECT OF THE PRODUCTS DELIVERED, LATE DELIVERY, ETC.) OBTAIN PAYMENT OF DAMAGES AND INTEREST EXCEEDING THE AMOUNT OF THE PRICE PAID BY THE USER FOR THE PRODUCT(S) WHICH GIVE RISE TO SUCH REQUEST.


GRANGETTES DISCLAIMS ALL RESPONSIBILITY IN CASE OF FAULT OF ITS AUXILIARIES.

 

force majeure

Grangettes will make every effort to fulfill its obligations in accordance with the General Conditions of Sale.

Intellectual property

Grangettes holds the intellectual property rights to the Site and its content. It is therefore entitled to distribute the elements appearing in the catalog of the electronic store and in particular the photographs for which it has obtained the necessary authorizations from the persons concerned.

Consequently, the partial or total reproduction, on any medium whatsoever, of the elements making up the Site and the catalog (in particular, graphics, video sequences, brands, sounds, drawings, models, texts, illustrations, logos, etc.), their use and their provision to third parties are strictly prohibited.

The User who has a website for personal or professional purposes and who wishes to place a link on his site directly to the home page of the Site must request authorization from Grangettes. In the event that Grangettes accedes to the request of this third party, the latter may in no case deduce from said acceptance the conclusion of any partnership in any form whatsoever. In any case, any link, even tacitly authorized, must be removed on simple request from Grangettes.

Entirety

In the event that one of the clauses of the General Conditions of Sale is invalid, this can in no way affect the validity and compliance with the other provisions of the said General Conditions of Sale.

Jurisdiction - Applicable law

The sales of Grangettes products as well as these General Conditions of Sale are subject to Swiss law. In the event of a dispute, the courts of the canton of Geneva, Switzerland, have exclusive jurisdiction, subject to appeal to the Federal Court. The application of the United Nations Convention on Contracts for the International Sale of Goods concluded in Vienna on April 11, 1980 (CISG) is excluded.
